  • REGULATORY HISTORY
    • Conduct Proceeding - January 27, 2011

      Ari Benjamin Kulidjian was found to have engaged in professional misconduct for, with respect to each of three complaints: failing to respond promptly and substantively to the Law Society and failing to co-operate with an investigation of the Law Society by failing to produce information and documentation requested in communications from the Law Society. By Decision and Order dated January 27, 2011 the hearing panel ordered as follows: (1) The Lawyer shall be reprimanded. (2) The Lawyer shall pay to the Law Society costs of $3,000, payable within six months of the date of this Order, failing which interest will accrue at a rate of 2% per annum.

    • Conduct Proceeding - July 21, 2014

      Ari Benjamin Kulidjian was found to have engaged in professional misconduct for: failing to provide a substantive response to communications from the Law Society regarding the complaint of MG; failing to co-operate with an investigation of the Law Society by failing to provide a substantive response to requests from the Law Society; failing to co-operate with an investigation of the Law Society by failing to produce information and documentation requested of him, including books and records of his practice; failing to provide a substantive response to communications from the Law Society. By Decision and Order dated July 21, 2014, the Hearing Division ordered as follows: (1) The Respondent is suspended for 2 months, commencing at the conclusion of his current administrative suspension and continuing indefinitely until, to the satisfaction of the Executive Director, Professional Regulation of the Law Society, he has: (a) provided a complete response to requests made in communications from the Law Society, as set out in particulars (1) and (2) of Notice of Application LCN09/14; and (b) provided a complete response to requests made in communications from the Law Society, as set out in particulars (1) and (3) of Notice of Application LCN50/14, as amended. (2) The Respondent shall comply fully with the terms of the Law Society's Guidelines for Lawyers Who Are Suspended or Who Have Given an Undertaking Not to Practice while suspended under this Order. (3) The Respondent must, within ten days of this Decision and Order provide the Membership Services Department with current contact information at which he can be reached including his address, his telephone number, his e-mail address, and his facsimile number (if he has a facsimile number). The Respondent must specify whether the contact information he is providing is his home or business contact information. (4) The Respondent shall pay costs to the Law Society in the amount of $7500.00 on or before July 21, 2017. Commencing on July 22, 2017, interest shall accrue on any unpaid costs at a rate of 3% per annum.

    • Conduct Proceeding - May 05, 2015

      Ari Benjamin Kulidjian [Respondent] was found to have engaged in professional misconduct for: (1) In relation to complaint A, failing to provide a prompt and complete response to communications from a Law Society investigator, despite communications on or about January 24, March 20, April 5, May 9, June 4, June 12, June 14, June 18, June 20, and June 28, 2013. (2) In relation to complaint B, failing to provide a prompt and complete response to communications from a Law Society investigator, despite communications on or about March 5, April 3, April 19, May 9, June 4, June 12, June 14, June 18, and June 20, 2013. By Decision and Order dated May 5, 2015, the Law Society Tribunal - Hearing Division ordered that: (1) The Respondent's licence to practice law shall be suspended for a period of one (1) month, commencing at the termination of the suspension ordered in application file nos. LCN09/14 and LCN50/14. (2) While his licence is suspended, the Respondent shall fully comply with the terms of the Law Society's Guidelines for Lawyers Who Are Suspended or Who Have Given an Undertaking Not to Practice. (3) The Respondent shall pay costs of $ 3000.00 to the Law Society by the deadline of May 5, 2021. (4) If the Respondent fails to pay any portion of the costs by the deadline set out in paragraph 3 of this Decision and Order, then interest shall accrue on the unpaid costs at a rate of 2% per year from the date of the default.

    • Conduct Proceeding - September 09, 2015

      Ari Kulidjian was found to have engaged in professional misconduct for: (1) failing to pay for services rendered to him by Victory Verbatim Reporting Service during the period 2008 to 2011, in the amount of $3,366.24, a financial obligation incurred in relation to his practice. (2) in relation to the complaint of Victory Verbatim Reporting Service, failing to provide a substantive response to communications from the Law Society, including letters dated November 30, 2011, December 15, 2011, January 26, 2012 and July 19, 2012; e-mail communications, dated March 2, 2012, April 25, 2012, May 16, 2012 and August 29, 2012, and a voice mail communication dated January 10, 2012. (3) in relation to the complaint of Tippet Richardson Records Management, failing to provide a substantive response to communications from the Law Society, including letters, dated January 9, 2012, January 26, 2012, February 22, 2012 and July 19, 2012 and e-mail communications, dated March 2, 2012, April 25, 2012, May 16, 2012 and August 29, 2012. (4) in relation to the complaint of E.D. (S. Inc.), failing to provide a response to communications from the Law Society, including a letter, dated July 19, 2012 and e-mail communications dated April 25, 2012, May 16, 2012 and August 29, 2012. (5) from March 23, 2012, failing to co-operate with a Law Society investigation by failing to produce information and documentation requested of him, including the books and records of his practice. By Decision and Order dated September 9, 2015, the Law Society Tribunal - Hearing Division ordered that: (1) The Lawyer shall be suspended for a period of three months, commencing at the end of the one-month suspension ordered by the Hearing Division on May 5, 2015. (2) The suspension shall continue until, to the satisfaction of the Executive Director, Professional Regulation of the Law Society, he has paid the money he owes to Victory Verbatim Reporting Service, as set out in Particular 3 of Notice of Application LCN105/12, and he has provided a complete response to requests from the Law Society, as referenced in Particular 1 of Notice of Application LCN05/13. (3) The Lawyer shall comply fully with the terms of the Law Society's Guidelines for Lawyers Who Are Suspended or Who Have Given an Undertaking Not to Practise while suspended pursuant to this Decision and Order. (4) The Lawyer shall pay costs to the Law Society in the amount of $2,500 on or before July 9, 2021, failing which interest shall accrue on any unpaid portion of those costs at the rate of 2% per annum.

    • Conduct Proceeding - March 04, 2016

      Ari Benjamin Kulidjian was found to have engaged in professional misconduct for: on February 28, 2014, while administratively suspended by Summary Order dated July 25, 2013 and also by Summary Order dated September 26, 2013, holding himself out as someone who was entitled to practise law, thus improperly obtaining entry into a secured area of a detention centre. By Decision and Order dated March 4, 2016, the Law Society Tribunal- Hearing Division, ordered that: (1) The Lawyer shall be suspended for one month, to be served consecutively to his previously imposed administrative and disciplinary suspensions. (2) The Lawyer shall pay costs of $12,000, payable within six months of the date of this order, failing which interest shall accrue at the rate of 2% per year.

      • Appeal - June 27, 2017

        By Notice of Appeal filed on April 19, 2016, Ari Kulidjian (the "Lawyer") appealed the finding, penalty and costs ordered by the Law Society Tribunal - Hearing Division in its Decision and Order dated March 4, 2016. On June 27, 2017, the Law Society Tribunal - Appeal Division ordered the following: (1) The appeal is dismissed. (2) If the Law Society seeks costs, written submissions of no more than two pages, shall be delivered within two weeks of the date of this Order. Any responding submissions by the Lawyer, also not to exceed two pages, shall be delivered within four weeks. On August 22, 2017, the Law Society Tribunal - Appeal Division further ordered that: (1) The Lawyer shall pay costs of $8,000 to the Law Society within 18 months of this Order, failing which interest will accrue at a rate of 2% per year. (2) The Lawyer shall be given six months from the date of this Order to pay the costs of $12,000 that were awarded to the Law Society on the conduct proceeding, failing which interest will accrue at a rate of 2% per year.

In Private Practice
A lawyer who is practising law and/or providing legal services to clients. This includes sole practitioners; partners, associates and employees in law firms.

Practising Law - Employed
A lawyer who is employed practising law and/or providing legal services exclusively for the lawyer's employer.

Not Practising Law - Employed
A lawyer who is employed by an organization such as government, an educational institution, a company, a society, trade union, etc., and who does not provide legal services.

Not Practising Law
A lawyer who is not currently practising law and/or providing legal services.

Practice Restricted
A lawyer who is practising law but who is restricted in the manner or in the areas of law in which they may practise, or in the legal services they may provide. For example, the lawyer may only be permitted to practise as an employee or under the supervision of another lawyer, or may not be permitted to practise with respect to real estate matters.

Suspended Administratively
A lawyer who has been suspended for administrative reasons, such as failing to pay fees or file forms on time. A suspended lawyer is not permitted to practise law and/or provide legal services.

A former lawyer whose licence was revoked by order of the Law Society Tribunal. A person whose licence has been revoked is not licensed by the Law Society to practise law and/or provide legal services.

Licence Revoked - Administrative Suspension Over 12 Months
A former lawyer whose licence was revoked under subsection 48(1)(a) of the Law Society Act, following an administrative suspension that was still in effect more than 12 months after it was made. A person whose licence has been revoked is not licensed by the Law Society to practise law and/or provide legal services.

Licence Revoked - Regulatory Suspension Over 24 Months
A former lawyer whose licence was revoked under subsection 48(1)(b) of the Law Society Act, following a regulatory suspension that was still in effect more than 24 months after it was made. A person whose licence has been revoked is not licensed by the Law Society to practise law and/or provide legal services.

Licensee Participating in PBLO (PBLO Emeritus Lawyer)
A lawyer who only practises law through a program registered with Pro Bono Ontario.

Practising Law - Canadian Legal Advisor
A lawyer with a Class L3 licence who is employed practising law and/or providing legal services in Ontario. This includes sole practitioners; partners, associates and employees in law firms.

In Private Practice
A paralegal who is licensed to provide legal services in the areas permitted within the scope of practice. This includes sole practitioners; partners, associates and employees in paralegal firms.

Providing Legal Services - Employed
A paralegal who is employed and providing legal services exclusively for the paralegal's employer.

Not Eligible to Provide Legal Services - No Proof of Insurance
A paralegal who is not eligible to provide legal services - no proof of insurance.

Not Providing Legal Services - Employed
A paralegal who is employed by an organization such as government, an educational institution, a company, a society, trade union, etc., and who does not provide legal services.

Not Providing Legal Services
A paralegal who is not currently providing legal services.

Practice Restricted
A paralegal who is providing legal services but who is restricted in the manner or in the areas in which they may provide legal services, or in the legal services they may provide. Lawyer Licence Type Definitions

Class L1

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class L1 licence is entitled to practise law in Ontario as a barrister and solicitor.

Class L2

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class L2 licence is entitled to practise law in Ontario as a barrister and solicitor in the employ of the Attorney General for Ontario or, if appointed under the Crown Attorneys Act, as a Crown Attorney or as an assistant Crown Attorney.

Class L3

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class L3 licence is authorized to do any of the following:

  1. Give a person advice with respect to,
    1. the laws of Quebec,
    2. the laws of Canada, and
    3. public international law.
  2. Select, draft, complete or revise a document for use in a proceeding with respect to matters concerning the laws of Canada.
  3. Represent a person in a proceeding before an adjudicative body with respect to matters concerning the laws of Canada.

Paralegal Licence Type Definitions

Class P1

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class P1 licence is authorized to do any of the following:

  1. Give a party advice on his, her or its legal interests, rights or responsibilities with respect to a proceeding or the subject matter of a proceeding.
  2. Represent a party before,
    1. in the case of a proceeding in the Small Claims Court, before the Small Claims Court,7
    2. in the case of a proceeding under the Provincial Offences Act, before the Ontario Court of Justice,
    3. in the case of a proceeding under the Criminal Code, before a summary conviction court,
    4. in the case of a proceeding before a tribunal established under an Act of the Legislature of Ontario or under an Act of Parliament, before the tribunal, and
    5. in the case of a proceeding before a person dealing with a claim or a matter related to a claim, before the person.
  3. Anything mentioned in subsection 1 (7) of The Law Society Act, provided the activity is required by the rules of procedure governing a proceeding.
  4. Select, draft, complete or revise, or assist in the selection, drafting, completion or revision of, a document for use in a proceeding.
  5. Negotiate a party's legal interests, rights or responsibilities with respect to a proceeding or the subject matter of a proceeding.
  6. Select, draft, complete or revise, or assist in the selection, drafting, completion or revision of, a document that affects a party's legal interests, rights or responsibilities with respect to a proceeding or the subject matter of a proceeding.
